Union of India vs Harish Chandra Singh Rawat and Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

In this case, the Supreme Court modified its earlier order directing a floor test in the Uttarakhand Legislative Assembly. The issue arose when it was clarified that the post of "Principal Secretary, Legislative Assembly" did not exist; instead, a "Principal Secretary, Legislative and Parliamentary Affairs" existed. The Court held that to ensure objective supervision of the voting process and maintain democratic integrity, the Principal Secretary (from the District Judge cadre) should supervise the floor test alongside the Secretary of the Legislative Assembly. This modification was necessary to prevent any party from questioning the objectivity of the electoral process.
