In Brief
The Government sought to challenge a High Court order directing continuation of a stalled 329-km road project under a contract with M/s. Maytas-Gayatri, which had defaulted on work. The High Court had ordered the contractor to continue and payments to be made. The Supreme Court set aside the High Court's order, permitting the Government to retender the project and complete it within 3.5 years. Disputes over the contractor's prior work and compensation claims were directed to be resolved through the arbitration clause in their original agreement, not through judicial direction in the PIL, recognizing that public interest in project completion does not override contractual and administrative remedies."
