The Supreme Court granted interim stay of a Delhi High Court judgment that had struck down rules requiring six months' training for practitioners conducting pre-natal diagnostic procedures under the PCPNDT Act, 1994. The Court held that the Central Government possesses clear statutory power under Section 32 of the Act to prescribe qualifications and training requirements for such practitioners. The Court found the High Court erred in trenching upon legislative policy and in finding an absence of statutory authority. The Court emphasised that Parliament's policy choices cannot be revisited through judicial review, and its previous directions in Voluntary Health Association must be enforced untrammelled by contrary orders. Pending final disposal, the High Court's judgment was stayed.
