An Army officer commissioned in 1994 was posted to the Directorate General Quality Assurance (DGQA). After two years of service, his case for Permanent Secondment was rejected because Technical Assessment Reports (TARs) rated him 'not yet fit' and 'not fit'. He challenged this in the Delhi High Court, arguing that the applicable 2011 office memorandum setting out eligibility criteria made no mention of TARs. The Supreme Court upheld the High Court's decision, holding that the 2011 memorandum explicitly superseded all previous instructions, including an earlier 2004 memorandum that referenced TARs. TARs were not a criterion under the new rules.",
