Union of India vs Nisar Pallathukadavil Aliyar

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Union of India sought special leave to appeal against an Advisory Board's opinion finding no sufficient cause for the detention of Nisar Pallathukadavil Aliyar under the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974. The Supreme Court held that when the Advisory Board finds insufficient grounds for detention, the government must immediately revoke the detention order and release the detenu. The Court further held that a petition for special leave to appeal against the Advisory Board's opinion is not maintainable. Accordingly, the petitioner's appeal was dismissed and the detenu was directed to be released forthwith.">
