In Brief
The Supreme Court dismissed two Special Leave Petitions challenging a High Court order that had dismissed the Union of India's appeal from an arbitral award proceeding on grounds of delay. The appeal was filed 142 days after the dismissal of the underlying Section 34 application—well beyond the 120-day statutory limit (including grace period). The Court held that appeals under Section 37 of the Arbitration and Conciliation Act, 1996 must comply with the same 120-day deadline applicable to original Section 34 applications. No sufficient cause for the delay was shown. The petitions were disposed of accordingly.
