The Union Public Service Commission fixed qualifying cut-off marks at 38 for a 2004 Limited Departmental Competitive Examination to fill 299 vacancies for Section Officer posts. It later emerged that 148 candidates selected in 2004 had also competed and been selected in 2003, creating anomalies. The Central Administrative Tribunal and Division Bench ordered the Commission to reduce the cut-off marks to accommodate 119 additional candidates. The Supreme Court held that once qualifying marks are fixed for a particular year, all candidates must meet those uniform marks regardless of repeat candidates. The Court set aside the Tribunal and Division Bench orders, holding that no re-exercise of mark-fixing was required and those meeting the original marks could be promoted.",
