The University of Delhi engaged about 300 Junior Assistants on contract basis between 2003-2013, who sought regularization when the University advertised 255 permanent posts in 2013. While the High Court directed a special test for contract employees, the University challenged this. The Supreme Court held that contract employees cannot claim regularization under the Umadevi principle (which applies only to those with 10+ years service before Umadevi was decided in April 2006). However, to ensure fairness, the Court directed that contract employees be given age relaxation and service-based marks advantage (10-18 marks out of 300) when competing in regular selection processes, so they have a meaningful opportunity without circumventing constitutional recruitment requirements."
