University of Delhi vs Shashi Kiran & Ors. etc

Bench: 2 — Uday Umesh Lalit

In Brief

The University of Delhi appealed against high court decisions regarding employee pension rights. The case involved three categories of university teaching staff and their entitlement to either CPF or GPF/Pension schemes. The Supreme Court upheld decisions favouring employees in two categories: those who made no option (deemed to have chosen GPF) and those who opted for CPF after the deadline (also deemed to have chosen GPF). For employees who consciously chose CPF by the deadline but sought later switchover, the Court allowed them to switch to GPF with full refund of CPF contributions plus 8% interest, citing non-discrimination principles since 2,469 similar employees were already permitted such switchover.
