In Brief
The Supreme Court disposed of a Special Leave Petition challenging differential tax treatment of exporters based on turnover levels. The Court held that since the section 80HHC income tax benefit ceased to be available after 1 April 2005, exporters with turnover below and above 10 crores should receive identical tax treatment. The appeal was disposed of granting relief in line with this principle, recognizing that the statutory foundation for any distinction between these two classes of exporters had been removed by law.
