In Brief

The Supreme Court dismissed Civil Appeals filed by an Agricultural Horticultural Society and its Secretary challenging land resumption by the State of Tamil Nadu. The State had allotted land under an agreement allowing resumption for public purpose. When the State resumed the land in 1989 for sports and horticulture development, the Society challenged it, alleging mala fides based on political rivalry. The Court held that bare assertions of mala fides unsupported by material evidence cannot sustain a challenge to lawful State action. Since the resumption was valid under the allotment clause and for genuine public purpose, the appeals were dismissed.
