Vandana Chavan vs State of Madhya Pradesh and Anr

Bench: 2 — A.K. Sikri

In Brief

The appellant Vandana Chavan was named as an accused in a dowry harassment complaint (under IPC Section 498-A) filed by the wife of Anil Kaithwas, with the allegation that she had adopted Anil and was complicit in mistreatment. The appellant claimed she was merely a landlord and had come to assist in their wedding. The Supreme Court held that merely treating someone as one's son, without legal establishment of an adoption relationship, does not constitute sufficient grounds to implead a person as an accused in a dowry case. The Court partly allowed the appeal and set aside the proceedings against the appellant.
