Vasant Ganpat Padave (D) by LRs & Ors vs Anant Mahadev Sawant (D) through LRs & Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

This case concerns the statutory rights of cultivating tenants under the Bombay Tenancy and Agricultural Lands Act, 1948, particularly following the 1956 Amendment which introduced Tillers' Day. The Court examined whether a tenant's statutory right to purchase land applies when the landlord is a widow or person with disability. The Court held that on Tillers' Day, an absentee landlord loses title to agricultural land while a cultivating tenant gains title. A successor of a widow landlord must notify the tenant of this change so the tenant can exercise his statutory purchase right. The appeal was allowed.
