In Brief
When an executor dies during testamentary proceedings, the case does not automatically end or abate. The Supreme Court held that an executor's role is to pursue the will on behalf of all beneficiaries, not a personal interest. Therefore, when an executor dies, beneficiaries may step in and continue the case by applying for letters of administration with the will annexed instead of probate. Both proceedings serve the same purpose—establishing the authenticity of the will. This prevents unfair dismissal of cases and allows the estate administration to proceed efficiently.
