VENKITALAKSHMI vs K. RAJU AND ORS

Bench: 2 — Uday Umesh Lalit, Vineet Saran

In Brief

The appellant sought specific performance of agreements to purchase property dated 16 July 1980, having paid earnest money of Rs. 5,000. The High Court found the agreements' authenticity was not established, and rejected the claim that time for completion was extended. Finding the appellant failed to prove readiness and willingness to perform, the Court dismissed the suit for specific performance. However, recognizing the earnest money paid, the Supreme Court awarded compensation of Rs. 5 lakhs in addition to return of the earnest money amount.
