Vetindia Pharmaceuticals challenged its blacklisting by the Uttar Pradesh Government after its tender was rejected. The Supreme Court held that the blacklisting order was vitiated from inception for non-compliance with the Drugs and Cosmetics Act, 1940 procedures. The court found that evidence supporting the order was fabricated post facto. Though the writ petition had a delay, this did not bar it because the appellant had pursued the matter with authorities whose inaction caused the delay. The High Court erred in dismissing the petition on delay grounds without examining the illegality and disproportionality of the blacklisting order. The appeal was allowed.
