A daily-wage supervisor employed since 1980 sought regularization on a post after qualifications were relaxed by government circular, claiming his juniors had been regularized. The High Court's Single Judge granted regularization, but a Division Bench reversed this, applying the settled law in Secretary, State of Karnataka v. Umadevi. The Supreme Court upheld the Division Bench, holding that regularization requires two conditions: (1) appointment by competent authority, and (2) a sanctioned post. Both were absent here. The Court dismissed the appeal, reaffirming that regularization cannot be granted on equitable grounds or length of service alone.
