Vijay Hathising Shah appealed against a High Court order that allowed the respondent's application to amend her plaint in a partition suit. The Trial Court had rejected the amendment application as wholly belated, filed when trial was nearly complete. The Supreme Court held that the Trial Court was correct. The Court found the amendment was filed too late, when the case was ready for final arguments, and the suit could be decided without it. The appeal was allowed, the High Court order was set aside, and the Trial Court was directed to decide the civil suit within one month."
