Vijay Mahadeorao Kubade vs State of Maharashtra Through the Collector

Bench: 2 — N.V. Ramana

In Brief

A landowner's predecessor challenged a land acquisition compensation award and sought enhancement under the Land Acquisition Act. The State raised a limitation defence, arguing the reference was filed beyond the 30-day window. The Supreme Court held that a valid notice under Section 12(2) requires the award itself to accompany the notice; a mere letter informing about the award is insufficient. Since the certified copy of the award was received separately weeks later, the reference filed within 30 days of receiving it was not barred by limitation. The Court set aside the High Court's order and remanded the matter for determination on compensation merits.
