The appellant, a milk seller, was convicted under the Prevention of Food Adulteration Act, 1954 for selling adulterated buffalo milk based on an Analyst's report showing deficiency in milk fat and non-fatty solids. The Supreme Court allowed his appeal, holding that the prosecution failed to prove actual delivery of the Analyst's report to the appellant as required by Section 13(2), merely proving despatch without receipt. Further, the independent witness required by law did not support the prosecution's case, leaving only the uncorroborated Food Inspector's testimony that the sample was properly collected. The Court found that without corroboration and proof of proper sampling procedure, the conviction was unsafe and set it aside, acquitting the appellant.
