VINOD DUA vs UNION OF INDIA & ORS

Bench: 2 — Uday Umesh Lalit, Vineet Saran

In Brief

A television journalist, Vinod Dua, challenged an FIR for statements made in his YouTube talk show criticizing government preparedness for COVID-19, claiming violations of press freedom. The Supreme Court quashed the FIR, holding that critical analysis of government action, even if containing factual inaccuracies, does not constitute sedition under Section 124-A IPC unless intended to incite violence or create public disorder. The Court distinguished the journalist's statements as protected commentary under Article 19(1)(a). However, the Court rejected the journalist's plea for guidelines requiring committee approval before registering FIRs against journalists, ruling such directives would improperly encroach upon legislative authority and create unconstitutional discrimination.
