In Brief
This case clarifies directions from a prior 2022 judgment regarding pension benefits for women Short Service Commissioned Officers (SSCOs) who were released after fourteen years but deemed to have completed twenty years' qualifying service. The Court held that pension must be computed using the salary applicable on the deemed completion date (twenty years), with notional increments granted for the intermediate period. Commuted value must use the factor applicable on the deemed date. Women SSCOs are entitled to ECHS benefits as retired officers and differential annual leave encashment up to 300 days. Pension Payment Orders must be corrected to reflect proper status, with arrears payable by June 15, 2024.
