Supreme Court of India 2022-04-22 dismissed

Widescreen Holdings Private Limited & Anr. etc vs Religare Finvest Limited & Anr. etc

Bench: 2 — <UNKNOWN>

In Brief

In this arbitration case, Widescreen Holdings and another challenged the High Court's order regarding the impounding of a loan agreement containing an arbitration clause. The petitioners had failed to produce the original loan agreement in the arbitration proceedings despite relying on the arbitration clause within it. The Supreme Court upheld the High Court's decision, holding that no document can be impounded unless it is first produced before a court or tribunal. The Court observed that the Arbitrator would appropriately consider the claimant's conduct in failing to produce the document when rendering the award. The Special Leave Petition was dismissed.
