Y.P. Sudhanva Reddy & Ors vs Chairman And Managing Director, Karnataka Milk Federation Etc

Bench: 2 — Abhay Manohar Sapre

In Brief

The appellants, as heirs of K.G. Yellappa Reddy, filed a suit seeking declaration of title to land and a permanent injunction against the respondent (Karnataka Milk Federation), claiming they inherited the land. The respondent, who had allotted the land by the State after its acquisition under the Land Acquisition Act in 1941, produced the acquisition notification as additional evidence in appeal. The Supreme Court held that once land is acquired by the State through statutory proceedings, the owner loses all title and ownership rights. Therefore, the suit was misconceived and not maintainable. The Court upheld the High Court's decision to admit additional evidence and dismissed the appeals.
