A government contractor challenged the partial termination of his highway construction contract. After filing a legal notice in January 2000 and subsequent letters detailing the unlawful termination and amounts owed, he filed suit in September 2002. The High Court dismissed the suit for non-compliance with Section 80 CPC notice requirements. The Supreme Court held that substantial compliance with Section 80(3) was sufficient. The legal notice, properly identifying the parties and clearly setting out the cause of action and relief, satisfied the statutory requirements even though it didn't expressly cite Section 80 or were sent before a pending Writ Appeal was dismissed. The Court set aside the High Court judgment and remitted for decision on merits.
