Yatin Narendra Oza, a Senior Advocate and former President of the Gujarat High Court Bar Association, had his Senior Advocate designation withdrawn by the High Court following serious misconduct. He wrote letters and held a press conference alleging impropriety against the High Court institution. The Supreme Court held that while the designation is a privilege (not a fundamental right) and therefore not justiciable under Article 32, it exercised discretion under Article 142 to temporarily restore the designation for two years, conditioned on immaculate conduct. The High Court was empowered to withdraw it permanently if further misconduct occurred. The Court emphasized that the privilege requires both legal acumen and exceptional behavioral standards.
