The Supreme Court held that a power of attorney involving transfer of possession of immovable property may constitute a conveyance requiring stamp duty as such. The court ruled that whether possession was actually transferred is a factual question requiring evidence, not determinable from the document alone. The case was remitted to the trial court to decide the stamp duty deficiency objection after hearing evidence on delivery of possession, rather than on a preliminary basis.
