Supreme Court allows Latha Rajnikanth to file an application seeking discharge from a cheating case

On October 10, 2023, the Supreme Court of India restored a cheating case against Latha Rajnikanth, wife of Tamil superstar Rajnikanth, on a complaint in relation to the alleged non-payment of dues for the promotion world for the 2014 film β€˜Kochadaiiyan’. The complaint was filed against her by a Chennai-based advertising company. The matter was heard by a two-judge bench including Justice MM Sundresh and Justice AS Bopanna. The bench allowed her to file an application seeking discharge from the case before the Trail Court. During the court proceedings, the SC bench was hearing two SPL petitions challenging the August 2022 decision of the Karnataka High Court quashing the charges of cheating and false evidence against Latha Rajnikanth and granting partial relief to her. The bench while hearing the matter on October 10 ordered β€œIn view of the earlier order passed by this Court on 10th July 2018 in Criminal Appeal No. 854 of 2018, the only way open to the petitioners (Latha) in SLP(Crl.) No. 8327 of 2022 is either to file an application seeking discharge or to face the trial.”
