Transfer of Justices Atul Sreedharan and Sanjeev Prakash Sharma of high Courts allowed by the Supreme Court Collegium

The transfer request of two High Court judges, Justice Atul Sreedharan and Justice Sanjeev Prakash Sharma of the Madhya Pradesh and Patna High Court respectively, was allowed by the Supreme Court Collegium on March 29, 2023. After a meeting held on March 28, 2023, the Supreme Court Collegium passed the resolution of the transfer of the aforementioned two judges of the High Court. 

Justice Sanjeev Prakash Sharma, currently serving as Judge in Patna High Court cited inadequate medical facilities in Patna. He sought a transfer to his parent High Court, Rajasthan High Court, owing to his health grounds but it could not be possible. Due to this, Justice Sanjeev Prakash Sharma sought a transfer to Punjab & Haryana High Court as Chandigarh has the necessary medical facilities. On the other side, Justice Atul Sreedharan wrote to the Collegium that he is seeking a transfer out of the state because his daughter is entering law practice soon there. 

The resolution by the Collegium stated that “The Collegium resolves that it is not possible to repatriate Mr. Justice Sanjeev Prakash Sharma to his parent High Court. Bearing in mind the health reasons which have led the judge to seek a transfer out of the High Court where he is posted at present, the Collegium resolves that Shri Justice Sanjeev Prakash Sharma be transferred, to the High Court of Punjab and Haryana.” Also, the Collegium recommended the transfer of Justice Atul Sreedharan to the Jammu & Kashmir and Ladakh High Court stating, “in the interest of better administration of justice.” In this way, the transfer of two judges of the High Court is allowed by the Supreme Court Collegium.
