Chandrababu’s plea against the Andhra Pradesh High Court’s order declining to quash a FIR: Supreme Court to continue hearing on October 10

Today, the Supreme Court bench was hearing the former Andhra Pradesh Chief Minister Chandrababu’s plea against the Andhra Pradesh High Court’s order declining to quash a FIR in connection with the skill development scam case. While hearing the plea, the bench asked whether the court can adopt an interpretation of Section 17A of the Prevention of Corruption Act of 1988 (that mandates prior sanction from the competent authority before launching an investigation against a public servant) which will defeat the objectives of the Act. A two-judge bench of the Supreme Court including Justice Bela M Trivedi and Justice Aniruddha Bose was hearing the matter. Today (October 09), Senior Advocate Harish Salve, appearing for the Telugu Desom Party chief and the opposition leader of AP, argued regarding the matter. He contended that “Section 17A is inserted the instances of regime revenge.” The Supreme Court to continue hearing the arguments tomorrow, October 10, 2023.
