On February 8, 2023, the top Court issued notice on a plea by Shelly Oberoi (Mayoral candidate of AAP) seeking early holding of MCD’s (Municipal Corporation of Delhi) Mayoral election. The notice was sent to the Delhi Lieutenant Governor’s office as well as Pro tem presiding officer of MCD’s office. The matter was presented before the Supreme Court bench headed by Chief Justice of India DY Chandrachud followed by two other SC judges, Justice JB Pardiwala and PS Narasimha. While dictating the order, the CJI said that “Issue notice returnable on Monday (February 13, 2023).”
AAP Mayoral candidate Shelly Oberoi approached the top Court earlier for the same demanding timely conduct of the elections but she had withdrawn the petition as elections were scheduled to be conducted on February 6, 2023.
