Update on Shiv Sena rift between Eknath Shinde and Uddhav Thackeray

The Supreme Court of India is hearing today the matter related to the Shiv Sena rift between Eknath Shinde and Uddhav Thackeray. The factions have been fighting for recognition as the real Shiv Sena. Last month, the Shiv Sena name and poll symbol was handed over to the Eknath Shinde faction by the Election Commission. The bench is hearing petitions that questioned the foundation of the Shinde government. Chief Justice of India (CJI) DY Chandrachud, while hearing the matter commented that “They broke bread for three years. They broke bread with Congress and NCP for three years. What happened overnight after three years of a happy marriage?” Today, the matter is presented before the Constitution bench comprising CJI DY Chandrachud, Justice PS Narasimha, Justice MR Shah, Justice Hima Kohli, and Justice Krishna Murari. On March 15, 2023, the bench raised various questions in association with the Governor’s decision to call for a trust vote. While hearing the case, the top Court said “The Governor must be conscious that calling for a trust vote may lead to the toppling of the government.” The Supreme Court further added, “The Governor should not enter any area which precipitates the fall of a government. People will start ditching the ruling party and the Governor will end up toppling the ruling party. This will be a sad spectacle for democracy.” The final verdict of the case may be delivered today.
