On May 22, 2023, the Supreme Court of India agreed to hear a plea filed by TMC member Abhishek Banerjee on May 26, 2023, challenging the CBI’s questioning in the school jobs scam case. The matter was presented before the vacation bench of Justices Sanjay Karol and Aniruddha Bose by Senior Advocate Abhishek Manu Singhvi, appearing for Abhishek Banerjee, to list the matter on an urgent basis. On May 20, Banerjee was questioned by the CBI for nine hours in connection with the probe into the school jobs scam case. While requesting the bench to list the matter for hearing later this week, Senior Advocate Singhvi told the bench “I am asking for no coercive step”. In this context, the Supreme Court’s vacation bench agreed to list the matter for hearing on Friday, May 26.

The West Bengal Chief Minister Mamata Banerjee’s nephew, Mr. Abhishek Banerjee alleged that the TMC leaders who were not willing to bend were harassed as well as the BJP leaders involved in various cases were allowed to go scot-free. It was determined that when CBI was investigating the criminal aspect of the scam, the ED was looking into the money trail that was involved in the alleged irregularities in school job recruitment.
