The plaintiff purchased a property by registered deed and sought injunction against the defendants from disturbing his possession. The defendants challenged this, claiming the title was defective. The High Court decreed the injunction based on the plaintiff's established possession and the fact that the defendant had previously lost a suit for declaration and recovery of possession of the same property. The Supreme Court upheld this, holding that in an injunction suit, the court need not examine title if possession is established and admitted. The distinction between injunction suits and declaration of title suits was clarified: in the former, title need not be proved if possession is clear; in the latter, the plaintiff must prove title on its own merits. The appeal was dismissed.
