Acqua Borewell Pvt. Ltd and others sought to partition their mother's property and obtained an interim injunction from the High Court restricting alienation to the extent of one-seventh share. Third parties who claimed interests in the properties through development agreements were not impleaded as defendants and not heard. The Supreme Court held that interim injunctions cannot be granted affecting third parties' claimed rights without impleading them as defendants and affording them a hearing. The Court quashed the High Court's injunction and remanded for the trial court to first decide applications to implead the third parties as necessary and proper defendants before reconsidering the injunction application."
