This case concerns a breach of an interlocutory injunction restraining transfer of undistributed land. After a 6900 sq. metre portion was transferred from a 20700 sq. metre property despite the injunction, the trial court ordered cancellation of the sale deed. The High Court disagreed, finding the transferees were not original defendants. The Supreme Court held that while cancellation may be extreme, the transfer violated the spirit of the injunction, which permitted only undivided share transfers. It directed the parties to execute a rectification deed clarifying the transfer was only of an undivided share, with no further alienation until the suit's conclusion.
