Smt. Barfi Devi (Dead) through L.R.s. & Ors vs State of Uttar Pradesh & Anr

Bench: 2 — M.R. Shah, A.S. Bopanna

In Brief

This case concerns land acquired in 1976 by the New Okhla Industrial Development Authority (NOIDA) from farmers. The original landowners challenged the compensation of Rs.4.628 per square yard awarded by lower courts, seeking Rs.297 per square yard based on judgments for other acquisitions. The Supreme Court held that compensation cannot be determined by analogy to lands acquired in later years (1977 or 1983) because developments occurred after 1980 and a development plan was sanctioned in 1983, making earlier acquisitions incomparable. The Court upheld the High Court's decisions and modified the compensation to Rs.28.12 per square yard, consistent with other awards for 1976 acquisitions.
