In Brief
Ajanta LLP designed and sold electronic calculators under the mark "ORPAT FX-991ES PLUS," copying Casio's protected design for "CASIO FX-991ES PLUS." Casio sued for design infringement. The parties settled via a consent decree prohibiting Ajanta from using the design and trademark marks including "FX," "991," and "FX-991ES PLUS." Ajanta later sought to modify the decree, claiming the settlement mistakenly included standalone marks "FX" and "991," when only "FX-991ES PLUS" was intended. The Supreme Court dismissed the appeal, holding that consent decrees create binding estoppel and cannot be altered for mere misunderstanding, especially when reached after detailed negotiations by expert counsel without fraud or misrepresentation.
