Ajaypal Singh alias Ajay vs State of Punjab

Bench: 1 — Hari Pal Verma

In Brief

A man settled in Malaysia returned to India to visit his family but was arrested when police raided his father's licensed chemist shop and recovered pharmaceutical tablets including Alprazolam and Oxytocin from the house annexe. The accused had no other criminal cases and the contraband was not recovered from him directly. The Supreme Court granted him regular bail, finding that his criminal responsibility had yet to be determined at trial, his father's licence as a chemist was relevant to the prosecution case, and prolonged custody served no useful purpose when trial would take considerable time."
