Akriti Land Con Pvt. Ltd vs Krishna Bhargava & Ors. etc. etc

Bench: 2 — Abhay Manohar Sapre

In Brief

In this family property dispute, a daughter of deceased Nandan Bhargava sought an injunction to restrain transfer of ancestral agricultural land pending partition proceedings. The Trial Court dismissed her temporary injunction applications, but the High Court allowed her appeals and granted status quo. On appeal by the purchaser-defendant, the Supreme Court declined to decide the merits but directed the Trial Court to expedite final trial within one year. The interim status quo order would continue pending final disposal, subject to modification based on the outcome. The Court emphasized that the Trial Court must decide purely on law and evidence without being influenced by any observations in the interim proceedings."
