The appellants challenged the Kerala High Court's remand of a land acquisition compensation dispute to a Reference Court. By consent of all parties, the Supreme Court disposed of the appeals by clarifying that the remand would be treated as an open remand. Both parties were permitted to adduce fresh evidence and raise all available legal contentions before the Reference Court. Significantly, the Reference Court was directed to answer the reference without being bound by or influenced by the High Court's prior observations and findings, thereby giving both sides a fair opportunity to present their complete case.
