Aman Sharma & Anr vs Umesh & Ors

Bench: 2 — J.K. Maheshwari

In Brief

The case concerns ownership of a property disputed between the plaintiffs (daughters of Sushila Kumari) and defendants (purported bona fide purchasers from Nand Kishore). The key issue was whether Nand Kishore, claiming title through a 1975 Will, could validly transfer the property to the defendants through a 2006 sale deed. The Supreme Court upheld the concurrent findings of three courts below that: Nand Kishore's Will was not validly proved; Krishna Kumar (the true owner) validly bequeathed the property to Sushila Kumari through a proved 1993 Will; and the plaintiffs inherited it after Sushila's death. Since Nand Kishore had no valid title, he could not transfer any title to the defendants. The appeal was dismissed.",
