Amazon invested $195 million (₹1,431 crore) in Future Retail Limited (FRL) with contractual protections against transfer of assets without its consent. When FRL announced a transaction with Reliance in August 2020 without seeking Amazon's approval, Amazon initiated arbitration and obtained an emergency interim award from an independent arbitrator appointing him under the Singapore International Arbitration Centre Rules. FRL violated this order, claiming it was a nullity. The Supreme Court held that Emergency Arbitrator awards are enforceable orders under India's Arbitration Act section 17(1), reflecting party autonomy and serving the statutory purpose of unclogging courts with expedited interim relief.
