Two landlords appealed a High Court order that allowed a tenant to retain a shop at Rs. 6,000 per month rent while being evicted from a residential house. The tenant owed substantial arrears of rent for both properties dating back to 1994 for the house and 2012 for the shop. The Supreme Court noted that the landlords had themselves conceded before the High Court that the tenant could keep the shop if enhanced rent was paid. Since the tenant deposited approximately Rs. 8.70 lacs toward arrears (calculated without interest), the Court disposed of the appeals, allowed the landlords to withdraw the deposited amount, and reserved the landlords' right to pursue fresh eviction proceedings for future defaults."
