A landlord sought eviction of tenants for parting with possession of rented shop premises without consent. The tenant claimed that a fair price shop licensee occupied one portion while the tenant ran a provision store in another portion, operating as partners from 1977. The Rent Controller found eviction warranted; the Tribunal and High Court reversed. The Supreme Court held that parting with possession of any part of the premises without written landlord's consent is sufficient ground for eviction under the Delhi Rent Control Act, 1958, regardless of whether characterized as partnership, license, or sub-letting. The appeal was allowed and tenants directed to vacate within two months.
