Amit Kumar Singh vs State of U.P. and Others

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Amit Kumar Singh filed an FIR under IPC Sections 307, 352, and 504 against respondents. Police closed the investigation, but the magistrate accepted Kumar's protest petition and issued summons. The respondents challenged this through a revision petition (dismissed) and a pending writ petition in the High Court. The Supreme Court held that both the criminal complaint trial and the writ petition proceedings should be tried together by the same court for consistency, subject to the condition that if the writ petition ultimately succeeds in quashing the summons, this joinder would not apply. The appeal was disposed accordingly.
