The High Court had cancelled these licenses, finding the methodology unfair and non-transparent. The Supreme Court affirmed the High Court's decision, holding that the First Come First Serve principle lacks statutory or policy foundation, is inherently discriminatory, and violates Article 14 of the Constitution. The Court found no evidence that this procedure was an established or codified practice. While dismissing the appeals, the Court clarified that all pending applications must be reconsidered under the State's new 2017 policy in a fair and transparent manner."
