Supreme Court of India 2016-11-15 dismissed

Ananthesh Bhakta Represented by Mother Usha A. Bhakta & Ors vs Nayana S. Bhakta & Ors

Bench: 2 — Ashok Bhushan

In Brief

In this appeal concerning a partnership dispute, the Supreme Court affirmed an order referring parties to arbitration under Section 8 of the Arbitration and Conciliation Act, 1996. The Court held that although the defendants initially failed to file original retirement and partnership deeds with their arbitration application, providing them before the Court's consideration satisfied the statutory requirement. The Court rejected contentions that not all parties were signatories to the arbitration agreement and that disputes over unregistered partnerships cannot be arbitrated. Where parties had agreed to arbitrate in their partnership deeds and those claiming rights through partners were bound by the agreement, referral to arbitration was proper.
