Anil Hoble vs Kashinath Jairam Shetye and Ors

Bench: 3 — A.M. Khanwilkar

In Brief

The appellant, Anil Hoble, challenged a National Green Tribunal order directing demolition of a commercial restaurant and bar structure built on a plot in Goa's coastal regulation zone (No Development Zone). The tribunal found that while a small garage structure existed on the plot in 1991, the current commercial building was substantially different in shape, size and location, and was erected after February 1991 when coastal zone restrictions took effect. The Supreme Court upheld the tribunal's factual finding and held that unauthorized structures within coastal no-development zones cannot be legalized by mere change of use or administrative permission, and must be demolished. Appeal dismissed."
