Anita and Others vs Arun Yadav and Others

Bench: 2 — Kurian

In Brief

This case concerns the computation of compensation in a fatal motor accident claim. The deceased was a driver. The key dispute was whether his monthly income should be assessed at Rs. 4,200/- or higher. The Supreme Court held that a driver is a skilled worker and should be assessed using the Government of Haryana's minimum wage rate of Rs. 4,360/- per month. After adding 50% for future prospects and deducting one-fourth for personal expenses, the monthly loss to the estate was Rs. 4,905/-. With a multiplier of 18, this yielded Rs. 10,59,480/-. The Court also affirmed the High Court's awards for loss of consortium and loss of love and affection to the widow and children. Total compensation awarded: Rs. 15,44,480/- with 9% interest."
